What Is Probate?

Probate is the legal process of administering someone’s estate after they pass away.

Grant of Probate

The official document that gives executors legal authority to deal with the estate — collecting assets, paying debts, and distributing to beneficiaries.

Do You Need It?

Not always. You typically need probate to sell property, access bank accounts above a certain threshold, or transfer investments. Our free assessment will confirm whether it’s required.

How Long Does It Take?

A straightforward estate typically takes 3–6 months. Complex estates may take longer. Your solicitor will keep you informed at every stage.

Fees from the Estate

For full estate administration, our fees are paid from the estate itself — not from your personal funds. No upfront costs for executors or family members.

Grant of Probate Only

We prepare and submit the full application on your behalf. Once the Grant is issued, you manage the administration yourself.

Full Estate Administration

Our solicitors manage everything from Grant of Probate through to final distribution. Fees are based on estate value and agreed with you in writing before any work begins. Paid from the estate — not personal funds.

    Typically 1–2 assets such as a property and bank accounts
    Capped 2%
  • Complex Estate
    Multiple properties, investments, intestacy, or foreign assets
    2–5%
If the matter becomes more complex than anticipated, your solicitor will always confirm any revised costs in advance. No unexpected charges.

Frequently Asked Questions

Not always. You typically need probate to sell property, access bank accounts above the bank’s threshold, or transfer investments. Small or jointly-held estates may not require it. Our free assessment will confirm either way.

A straightforward estate typically takes 3–6 months from instruction to completion. Complex estates may take 9–18 months. The Probate Registry currently issues Grants within 8–16 weeks of application.

IHT is charged at 40% on estate value above £325,000. The residence nil-rate band (up to £175,000) may also apply. Our solicitors will assess this during your free consultation.

With Grant Only, we handle the legal application and you then manage the estate yourself. Full Administration means our solicitors handle everything from start to finish — collecting assets, paying debts, and distributing to beneficiaries.
